These Terms and Conditions govern your use of TheWorks.bg website (www. theWorks.bg Site) and your relationship with TheWorks.bg (TheWorks, we or us). Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not open or use the TheWorks.bg Site. Please note that to use some of the services provided on the TheWorks.bg Site, you are required to register as an authorised user of the site.

1. Use of TheWorks.bg Site

The TheWorks.bg Site is provided to you free of charge for your personal use subject to these Terms and Conditions. By using the TheWorks.bg Site you agree to be bound by these Terms and Conditions.

TheWorks.bg Site is made up of a number of websites, including for example, Maintenance Works (home works, block works, office works), Design Works, food works. These Terms and Conditions govern all of the areas within the website and any external links to sites owned by the works ltd.

Please note that some of The Works.bg sites are not operated by The Works and any services ordered from them subject to their own terms and conditions. For the purpose of these Terms and Conditions, these sites are not classified as part of the TheWorks.bg.At present The Works is only deliverying products and services within Bulgaria and not outside, this region.

CONDITIONS DO NOT AFFECT YOUR STATUTORY RIGHTS.

2. Amendments

We may update these Terms and Conditions from time to time and any changes will be notified to you via the e-mail address provided by you on registration or via a suitable announcement on the TheWorks.bg Site. The changes will apply to the use of the TheWorks.bg Site after we have given notice. If you do not wish to accept the new Terms and Conditions you should not continue to use the TheWorks.bg Site and the Online Stores. If you continue to use the TheWorks.bg Site after the date on which the change comes into effect, your use of the TheWorks.bg Site indicates your agreement to be bound by the new Terms and Conditions.

3. Registration

To register with TheWorks.bg you must be over eighteen years of age.

You must ensure that the details provided by you on registration or at any time are correct and complete.

You must inform us immediately of any changes to the information that you provided when registering by updating your personal details.

4. Password and security

When you register to use the TheWorks.bg Site you will be asked to create a password. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible for all activities and orders that occur or are submitted under your password. If you know or suspect that someone else knows your password you should notify us by contacting Customer Services (see below for contact details) immediately.

If TheWorks.bg has reason to believe that there is likely to be a breach of security or misuse of the TheWorks.bg Site, we may require you to change your password or we may suspend your account in accordance with paragraph 13 below.

5. Standard Bonus Points Terms and Conditions

5.1 Using Bonus points (Not active as yet)

Bonus points can only be used online at www.TheWorks.bg subject to these general terms and conditions, and any other specific conditions notified to you on the issue of a bonus points. No bonus points are redeemable through any website owned or operated by The Works other than TheWorks.bg or any The Works store.

Bonus points are redeemed by entering its code at the appropriate point in the online purchase process. Redemption may be subject to you providing proof of entitlement to use the Bonus Points.

Your use of an Bonus points indicates your agreement to be bound by these Bonus point Terms and Conditions.

The Works reserves the right to withdraw or cancel bonus points for any reason at any time.

5.2 Distribution of Bonus Points

Bonus points are, and remain at all times, the property of The Works Ltd.

The right to use bonus points is personal to the original recipient and may not be transferred. No Bonus points may be copied, reproduced, distributed, or published directly or indirectly in any form or by any means for use by an entity other than the original recipient, or stored in a data retrieval system, without the prior written permission of The Works Ltd.

Bonus points distributed or circulated without the written approval of The Works Ltd, for example on an Internet message board or on a "bargains" website, are not valid for use and may be refused or cancelled.

5.3 Permitted usage of Bonus Points

Unless expressly stated otherwise at the time of issue of the Bonus Points;

- Each issued bonus point will be valid for use by a recipient only once,

- Bonus point will be valid for use per customer or household, as the case may be, and,

- Bonus points may not be used in conjunction with any other special offer or bonus point.

Even where bonus points expressly state at the time of issue that they may be used in conjunction with other bonus points or offers, any bonus point code beginning AA may not be used in conjunction with any other bonus point that also begins AA.

Even where bonus points expressly state at the time of issue that they may be used in conjunction with other bonus points or offers, any bonus point code beginning TW may not be used in conjunction with any other eCoupon code that also begins TW.

Bonus points cannot be exchanged for cash or used to purchase gift-vouchers.

5.4 Excluded goods and services

Certain goods or services may be excluded from bonus point offers any such further exclusion will be shown via TheWorks.bg website.

Bonus points may be limited to redemption in respect of certain products or services or certain products or services may be excluded from the ambit of use of the bonus points, in which case notice will be given to you at the time of issue of the bonus points.

Excluded goods and services will not count towards any qualifying conditions for offers and will not benefit from any promotional discount.

5.5 Minimum spend requirements

Where the redemption of an Bonus points are subject to a minimum spending requirement, the redemption is only permitted in respect of the purchase of qualifying products which will be communicated to you at the time of issue of the Bonus points. Excluded products and supplementary charges, such as delivery, gift wrap or postage & packing, shall not count towards a minimum spending requirement.

5.6 Calculation of discount

Where an online offer states that a percentage discount will be given on a purchase, the cost of the qualifying purchases will be reduced by the stated discount percentage.

Supplementary charges such as delivery or postage & packing shall not be discounted unless specifically stated in the offer description.

5.7 Security and Fraud

When you use Bonus points you warrant to The Works that you are the duly authorised recipient of the Bonus points and that you are using it in good faith.

If you redeem, attempt to redeem or encourage the redemption of Bonus points to obtain discounts to which you or a third party are not entitled you may be committing a civil or criminal offence.

If we reasonably believe that any Bonus Points are being used unlawfully or illegally we may reject or cancel any Bonus Points and you agree that you will have no claim against us in respect of any rejection or cancellation. The Works reserves the right to take any further action it deems appropriate in such instances.

If we refuse Bonus points submitted as part of an order, for any reason, we will inform you before the order is dispatched to advise of the correct cost of the order and give you the opportunity to cancel the order.

5.8 Limitation of liability

At all times our acceptance of an order takes place on despatch of the order, at which point the purchase contract will be made and you will be charged for your order.

All offers are subject to availability and while stocks last.

The Works shall not be liable to any customer or household for any financial loss arising out of the refusal, cancellation or withdrawal of any bonus points or any failure or inability of a customer or household to use bonus points for any reason.

5.9 Miscellaneous

We reserve the right to vary or terminate the operation of any bonus points at any time without notice.

The failure of The Works to take any action in respect of a breach of these terms and conditions shall not constitute a waiver of their enforceability. The Works reserves its rights in respect of these terms and conditions at all times.

6. Refunds on promotional offers

Refunds for goods purchased under a promotional offer will be based on the terms of the promotional price. Your statutory rights are not affected.

7. Excluded Services

The services provided by the TheWorks.bg Site do not include the provision of computer or other necessary equipment to access the TheWorks.bg Site. To use the TheWorks.bg site you will require Internet connectivity and appropriate telecommunication links. We shall not be liable for any telephone or other costs that you may incur.

8. Intellectual property

The content of the TheWorks.bg Site is protected by copyright, trade marks, database and other intellectual property rights. You may retrieve and display the content of the TheWorks.bg Site on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the TheWorks.bg Site without written permission from TheWorks.bg.

No licence is granted to you in these Terms and Conditions to use any trade mark of TheWorks.bg or its affiliated companies including, without limitation, the trade marks THE WORKS LTD (EOOD), THEWORKS.bg and THE WORKS Bonus point.

9. Limitations

You may not use the TheWorks.bg Site for any of the following purposes:

a) disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material

b) transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice

c) gaining unauthorised access to other computer systems

d) interfering with any other person's use or enjoyment of the TheWorks.bg Site

e) breaching any laws concerning the use of public telecommunications networks

f) interfering or disrupting networks or web sites connected to the TheWorks.bg Site

g) making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner

TheWorks.bg reserves the right to refuse to post material on the TheWorks.bg Site or to remove material already posted on the TheWorks.bg Site.

You will indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgment by a court of competent jurisdiction and all settlements sums paid by us as a result of any settlement agreed by us arising out or in connection with:

h) any claim by any third party that the use of the TheWorks.bg Site by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice;

i) any claim by any third party that the use of the TheWorks.bg Site by you infringes that third party's copyright or other intellectual property rights of whatever nature; and

j) any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with the use of the TheWorks.bg Site by you.

10. Availability of the TheWorks.bg Site

Although TheWorks.bg aims to offer you the best service possible, TheWorks.bg makes no promise that the services at the TheWorks.bg Site will meet your requirements. TheWorks.bg cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it to the Customer Services (see below for contact details) or by email at info@TheWorks.bg and we will attempt to correct the fault as soon as we reasonably can.

Your access to the TheWorks.bg Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. TheWorks.bg will attempt to restore the service as soon as it reasonably can.

11. The Works.bg's right to suspend or cancel your registration

TheWorks.bg may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions.

You can cancel this agreement at any time by informing us in writing. If you do so, you must stop using the TheWorks.bg Site.

The suspension or cancellation of your registration and your right to use the TheWorks.bg Site shall not affect either party's rights or liabilities.

Paragraphs 9 and 10 of these Terms and Conditions shall survive cancellation.

12. TheWorks.bg's liability

The TheWorks.bg Site is provided by TheWorks.bg without any warranties or guarantees. You must bear the risks associated with the use of the Internet.

The TheWorks.bg Site provides content from other Internet sites or resources and while TheWorks.bg tries to ensure that material included on the TheWorks.bg Site is correct, reputable and of high quality, it cannot accept responsibility if this is not the case. TheWorks.bg will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the TheWorks.bg Site. If TheWorks.bg is informed of any inaccuracies in the material on the Site we will attempt to correct the inaccuracies as soon as we reasonably can.

In particular, we disclaim all liabilities in connection with the following:

a) incompatibility of the TheWorks.bg Site with any of your equipment, software or telecommunications links

b) technical problems including errors or interruptions of the TheWorks.bg Site

c) unsuitability, unreliability or inaccuracy of the TheWorks.bg Site

d) inadequacy of the TheWorks.bg site to meet your requirements

To the full extent allowed by applicable law, you agree that we will not be liable to you/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the TheWorks.bg Site.

Nothing in this paragraph applies to The Works.bg's liability in respect of products sold through the Online Stores.

Nothing in these Terms and Conditions shall exclude TheWorks.bg's liability for personal injury or death caused by its negligence.

Our acceptance of an order takes place on despatch of the order, at which point the purchase contract will be made and you will be charged for your order.

13. Third Party Websites

As a convenience to TheWorks.bg customers, the TheWorks.bg Site includes links to other web sites or material which are beyond its control. TheWorks.bg is not responsible for content on the Internet or World Wide Web pages on other websites.

14. Advertising and Sponsorship

Part of the TheWorks.bg Site may contain advertising and sponsorship. Advertisers and Sponsors are responsible for ensuring that material submitted for inclusion on the TheWorks.bg Site complies with relevant laws and codes. We will not be responsible for any error or inaccuracy in advertising and sponsorship material.

15. Applicable Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Bulgaria and any disputes will be decided only by the Bulgarian courts.

16. International Use

TheWorks.bg makes no promise that materials on the TheWorks.bg Site are appropriate or available for use in locations outside Bulgaria, and accessing the TheWorks.bg Site from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside Bulgaria, you do so on your own initiative and are responsible for compliance with local laws.

17. Expiry Date on Payment Card

Please ensure that the expiry date of your payment card is after the anticipated despatch date of your order. Payment is taken at the point of despatch for goods and in the event that the payment card has expired we will be unable to take payment and fulfil your order.

18. Use of Community Sites

Each Community Site on the TheWorks.bg site (together the "Community Sites") allows users to interact with each other via blogs, and other user forums. We advise you not to post or in anyway reveal any of your personal details on the Community Sites (for example, your address and telephone number).

You may not use the Community Sites for any of the following purposes:

a) disseminating any unlawful, harassing, libellous, defamatory, racially offensive, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material;

b) transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice;

c) transmitting material containing any form of advertising or promotion for goods and services, junk mail, chain letters or "spam";

d) gaining unauthorised access to other computer systems;

e) interfering with any other person's use or enjoyment of the Community Sites;

f) making or transmitting or storing electronic copies of materials protected by copyright without the permission of the owner;

g) impersonating another person;

h) referring to specific website addresses outside of TheWorks.bg; or

i) advertising

The Works does not control the content placed on the Community Sites. However, The Works reserves the right to refuse to post material, to remove material posted on the Community Sites and to contact you in the event that there are concerns about the content you have added to a Community Site. The Works may review or edit the content of the Community Sites. Therefore, if you have concerns about any of the content of the Community Sites you should contact us by selecting the "report as inappropriate" button. The relevant content may be removed from the Community Sites. If we believe that any material placed on the Community Sites by you is unlawful we may contact the relevant authority.

The Works makes no representations as to the validity of any opinion, advice, information or statement displayed on the message boards by third parties. You are solely responsible for the content of your messages posted on the message boards and the views expressed by individuals do not represent the views of TheWorks.bg.

You will be responsible for:

j) any claim by any third party that the use of the Community Sites by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice;

k) any claim by any third party that the use of the Community Sites by you infringes that third party's copyright or other intellectual property rights of whatever nature;

l) any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with the use of the Community Sites by you.

By submitting material you are granting TheWorks a perpetual, royalty-free, non-exclusive licence to reproduce, modify, translate, make available, distribute and sublicense the material in whole or in part and in any form.

You will be responsible for our losses and costs resulting from your breach of these Community Sites terms and conditions.

19. Miscellaneous

You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.

If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.

If you breach these Terms and Conditions and TheWorks.bg ignores this, TheWorks.bg will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.

TheWorks.bg shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its control.

A person who is not a party to these Terms and Conditions shall have no right to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.

Grocery Store Product Terms & Conditions

Please read these product terms and conditions carefully as they affect your rights and liabilities under the law and set out the terms under which Tesco makes the products available to you ("Product Terms").

1. Prices

Please note that the prices on our Grocery website are guide prices only. The actual price you pay will be the price charged in store at the time your order is picked for delivery. The actual order value cannot be determined until the day of delivery because the prices stated on the website may vary either above or below the prices in store on the day your order is picked and delivered.

All prices are expressed inclusive of any VAT payable unless otherwise stated. When your order is delivered you may return any item and receive a full refund if you consider that the difference between the price charged and the guide price shown on the Grocery website is unacceptable.

2. Availability

If for any reason beyond our reasonable control, we are unable to supply a particular item, we will not be liable to you. Please note that we will attempt to deliver substitute lines should selected lines be unavailable unless you request us not to do so.

Although we will always try to cater for your orders, an order of large quantities of a line can only be fulfilled at the discretion of the works ltd. We will inform you via email or contact you by phone if there is a problem with your order quantities.

3. Acceptance

There will be no contract of any kind between you and us unless and until we actually dispatch the goods to you. Your order is an offer to buy from us. Nothing that we do or say will amount to any acceptance of that offer until we actually dispatch the goods to you. At any point up until then, we may decline to supply the goods to you without giving any reason. At the moment that the goods are dispatched (and not before), a contract will be made between you and us, and you will be charged for the goods.

4. Delivery

Delivery will be made to the address specified by you on the completed order form.

We will deliver your order to the main entrance of the delivery address. At your request, our driver may carry your order into the delivery address, for example, to a particular floor in an apartment block or into your kitchen but only if: a. the driver has your permission and b. our driver believes that it is safe and practical to do as you request. We always reserve the right to deliver only to the main entrance of the delivery address.

Please note that we deliver goods only to specified Sofia at present.

Delivery times will be agreed with you at the time of placing your order.

All goods must be signed for on delivery by an adult aged 18 years or over. The Works follows a "Think 21" policy, so if the person receiving the goods looks under 21, proof of age will be requested. If proof is not available and there is no-one of that age at the address when delivery is being made, the goods may be retained by the driver. If we attempt to deliver your order to the delivery address as arranged with you but there is nobody at the delivery address to accept your order, the driver will leave notification of attempted delivery and you will need to contact our Customer Service Centre to re-arrange delivery (see below for contact details).

In these circumstances, if we have to return to deliver the goods, a further charge may become payable provided that delivery is attempted at the agreed time.

Whilst we make every effort to deliver all your goods in the agreed time, we will not be liable if we fail to do so in part or in full due to circumstances beyond our control.

5. Returns of non-perishable items

We hope you will be happy with your purchase. However, should you feel it necessary to return an item, we aim to make the returns process as simple as possible.

If you are unhappy with any non-perishable items, simply contact us through info@theworks.bg keep in the original packaging within 7 days of despatch and we will give you a refund on those products or replace the item.

Please note that, in the event of a refund, all Clubcard points received for the purchase of the refunded goods will be removed from your Clubcard account.

Your statutory rights are not affected.

6. Cancellation

You can cancel or change any of your current orders up until 4pm on the day before delivery, Monday to Friday. You can do this by contacting us on our customer service number (see below for details)

7. Payment

You can pay in cash on delivery or by Mastercard or Visa credit card, Maestro or Delta debit card. We do not currently accept Visa Electron cards.Your credit/debit card details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of placing your order. You will not be charged until your order is ready for dispatch.

Our liability to you in connection with any order will not exceed the total price charged for the relevant items.

We accept orders only from Web browsers that permit communication through Secure Socket Layer (SSL) technology, for example, 3.0 version or higher of Explorer and versions 3.02 or higher of Netscape. This means you cannot inadvertently place an order through an unsecured connection.

8. General

These Product Terms shall be governed by and construed in accordance with the laws of Bulgaria and any disputes will be decided only by the Bulgarian courts.

If any of these Product Terms is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Product Terms which will continue to be valid and enforceable to the fullest extent permitted by law.
